Default Windage tray contacts oil pan

I am getting into interference problems using a factory 1976 oil pan and 3/4windage tray. The tray is contacting the pan ahead of the sump in the shallow section above main bearings 2 & 3. With the pan in position without a gasket, there is a 1/8" gap at the pan rails near the front of the engine. Does anyone see this as a problem or is it safe to bolt it down knowing the tray will be in contact with the pan?
